These Terms of Service govern your access to and use of the ScriptExpert website, marketplace, applications and related services.
By creating an account, purchasing or downloading a product, publishing a product, subscribing to a service or otherwise using ScriptExpert, you agree to these Terms.
Please read them carefully before using the platform.
1. About ScriptExpert
ScriptExpert is an online marketplace for digital products, including software applications, source code, scripts, plugins, templates, themes, mobile applications, desktop applications, design resources, developer tools and related digital content.
The platform allows independent developers, designers and other digital creators, referred to in these Terms as “Authors”, to publish and license their products to customers.
ScriptExpert provides the technical infrastructure through which products may be displayed, hosted, promoted, licensed, downloaded and paid for. ScriptExpert may also provide payment facilitation, customer assistance, product review, security monitoring and subscription-based tools for Authors.
Unless a product page expressly states that the product is sold directly by ScriptExpert, the product is supplied by the Author identified on that product page.
2. Platform operator
ScriptExpert is operated by:
Legal name: Amicii Distral S.R.L
Registered office: Bulevardul Republicii 15, Eforie Sud, Romania
Company registration number: 44857532
VAT number: RO44857532
Contact email: support[@]scriptexpert.net
In these Terms, “ScriptExpert”, “we”, “us” and “our” refer to the legal entity identified above.
3. Eligibility
You must be at least 18 years old or have reached the legal age required to enter into binding contracts in your country.
When using ScriptExpert on behalf of a company, agency or other organisation, you confirm that you have the authority to accept these Terms on its behalf.
You must not use the platform where doing so would violate applicable law, sanctions, export restrictions or another legally binding obligation.
4. The role of ScriptExpert
ScriptExpert operates primarily as an online marketplace and hosting service.
Authors use the platform to make independently created digital products available to customers. The Author determines the product’s features, description, technical requirements, supported environments, licensing conditions and support commitments, subject to the rules of the platform.
Unless clearly stated otherwise on the relevant product page:
the purchase or licence agreement for a third-party product is concluded between the customer and the Author;
the Author is the supplier and licensor of the product;
ScriptExpert is not the developer, publisher or owner of that product;
ScriptExpert does not take ownership of the Author’s source code or intellectual property; and
ScriptExpert receives a commission for providing marketplace and related services.
ScriptExpert is responsible for operating its own platform, providing the services sold directly by ScriptExpert and complying with the legal obligations applicable to an online intermediary.
Nothing in these Terms excludes or limits any responsibility that ScriptExpert cannot lawfully exclude.
5. Information about Authors
Authors may be individuals, sole traders, companies or other legal entities.
Each Author must declare whether they are acting as a professional trader in connection with the products they sell. Relevant information about the Author and their trader status will be displayed on or made accessible from the product page.
Where an Author acts as a professional trader, applicable consumer protection rules may apply to the contract between that Author and a consumer.
Where an Author is not acting for purposes relating to a trade, business, craft or profession, certain statutory consumer rights that normally apply to contracts with professional traders may not apply. The customer will be informed of the Author’s declared status before completing the purchase.
Authors must provide accurate identification, contact, payment and tax information. ScriptExpert may verify this information before allowing an Author to publish products or receive payouts.
6. User accounts
Some features require a registered account.
You must provide accurate and current information and keep your login details confidential. You are responsible for activity performed through your account unless the activity resulted from a security failure attributable to ScriptExpert.
You must notify us without undue delay if you believe that your account has been accessed without permission.
Accounts may not be transferred, sold or shared in a way that circumvents product licences, account restrictions or platform fees.
We may request additional information where necessary to verify identity, prevent fraud, process payments, comply with tax reporting requirements or satisfy other legal obligations.
7. Products published by Authors
Authors are responsible for ensuring that their products:
are accurately and completely described;
contain the features represented on the product page;
are compatible with the environments and versions stated in the listing;
do not contain malicious code, undisclosed tracking, hidden access mechanisms or harmful functionality;
do not infringe intellectual property, privacy or other third-party rights;
comply with applicable laws and platform policies; and
include the documentation, files, licences, updates and support expressly promised in the listing.
ScriptExpert may perform technical, editorial, security or compliance checks. Such checks do not transfer the Author’s responsibility to ScriptExpert and do not represent a guarantee that every defect, vulnerability or legal issue has been identified.
Customers should review the product description, system requirements, supported versions, documentation, available demonstration and licensing terms before purchasing.
8. Orders and contract formation
Before placing an order, the customer will be shown the product, price, applicable taxes, selected licence, seller identity and other material purchase information.
An order becomes binding when the payment has been successfully authorised and an order confirmation has been issued, unless the transaction is subsequently cancelled because of fraud, an obvious pricing error, a legal restriction or a payment failure.
For third-party products, the order confirmation documents the contract between the customer and the relevant Author. ScriptExpert facilitates the transaction and may collect or transmit payment through an authorised payment service provider.
For subscriptions or services supplied directly by ScriptExpert, the contract is concluded between the customer or Author and ScriptExpert.
9. Prices, payments and taxes
Product prices are displayed in the currency indicated at checkout. Applicable VAT or other taxes may be included in the displayed price or calculated separately, depending on the customer’s location and applicable law.
Payments may be processed by third-party payment providers. Their own terms and privacy practices may apply to the payment transaction.
Customers must provide valid billing information and must not use payment methods without authorisation.
Authors are responsible for their own income, corporate, social security and other taxes arising from their sales, except for taxes that ScriptExpert is legally required to calculate, collect, report or remit.
ScriptExpert may withhold amounts where required by law, where payment information cannot be verified or where funds are reasonably required to cover refunds, disputes, fraud, chargebacks or other financial risks.
10. Author commissions and payouts
ScriptExpert charges Authors a commission for sales completed through the platform.
The applicable commission rate, payment processing costs and any other charges will be displayed in the Author account, pricing page or applicable commercial agreement before the Author offers products for sale.
ScriptExpert may deduct from an Author’s balance:
marketplace commissions;
payment processing costs;
applicable taxes;
customer refunds;
payment disputes and chargebacks;
promotional costs accepted by the Author; and
other amounts expressly agreed with the Author or required by law.
Payouts are made according to the schedule and minimum payment threshold displayed in the Author account. A reasonable holding period may be applied to cover refunds, fraud investigations, payment disputes and chargebacks.
If an Author’s balance becomes negative, ScriptExpert may recover the amount from future sales or request direct repayment.
11. Product licences
Purchasing a product does not normally transfer ownership of the product or its intellectual property.
The customer receives a limited licence to use the product according to the licence selected during checkout and the additional conditions stated on the product page.
Unless the applicable licence expressly permits it, the customer may not resell, redistribute, sublicense, share, publish or make the original product or source code available as a standalone product.
A customer may not use one licence for multiple projects, installations, customers or end products where the selected licence is limited to a single use.
Products may contain open-source components or third-party materials that remain subject to their own licences. Authors must identify any material licence conditions that affect how the product may be used.
A licence may be terminated if the customer materially violates its conditions. Termination does not affect statutory rights relating to a defective or non-conforming product.
12. Downloads, updates and support
The customer is responsible for downloading and securely storing purchased files while they remain available through the platform.
ScriptExpert does not guarantee that a third-party product will remain available indefinitely. A product may be removed because of legal issues, security risks, licence disputes, Author decisions or platform policy violations.
Where reasonably possible, customers who previously purchased a removed product may retain access to their existing download. Access may be disabled where continued distribution would be unlawful, unsafe or would infringe third-party rights.
Updates and support are provided only to the extent described on the product page.
A one-time product purchase does not automatically include lifetime updates, lifetime support or compatibility with future versions of operating systems, frameworks, browsers, third-party APIs or external services.
However, Authors remain responsible for updates, security fixes and conformity obligations required by applicable law or expressly promised at the time of purchase.
13. Consumer right of withdrawal
Consumers in the European Union or European Economic Area may normally have a statutory period in which they can withdraw from a distance contract.
Digital products are generally supplied immediately after payment. Before immediate access or downloading begins, a consumer may be asked to:
expressly request that supply begins during the withdrawal period; and
acknowledge that the statutory right of withdrawal will be lost once supply of the digital content begins, where applicable law permits this.
Where valid consent and acknowledgement have been obtained and the digital product has been made available, the consumer may no longer have a right to cancel the purchase simply because they changed their mind.
If the legally required consent, acknowledgement or confirmation was not obtained, the consumer retains the rights provided by applicable law.
The loss of the right of withdrawal does not remove the consumer’s rights where a product is defective, unsafe, unavailable or materially different from its description.
For subscription services, the consumer may have the right to withdraw within the applicable statutory period. If the consumer expressly requests that the service begins immediately, ScriptExpert may charge an amount proportionate to the service already provided where permitted by law.
14. Product conformity and refunds
Authors must supply products that conform to the contract and the description provided at the time of purchase.
Customers may contact ScriptExpert whenever a conformity issue becomes apparent, subject to applicable statutory limitation periods. ScriptExpert will provide a reasonable support and dispute-resolution process and may communicate with the Author on the customer’s behalf.
A customer may be eligible for repair, replacement, price reduction, account credit or a full or partial refund where, for example:
the purchased files were not delivered or cannot be accessed;
the product is materially different from its description or demonstration;
an advertised essential feature is missing;
the product does not function in the environment expressly stated as supported;
the product contains malware or an undisclosed serious security risk;
the Author cannot or refuses to correct a qualifying defect within a reasonable period;
support expressly included in the purchase is not provided; or
the same product was purchased more than once by mistake.
Depending on the nature and seriousness of the problem, the Author may first be given a reasonable opportunity to provide missing files, correct the defect, replace the product or bring it into conformity.
An immediate refund may be appropriate where correction is impossible, the defect is serious, the Author refuses to provide a remedy or applicable law gives the customer the right to terminate immediately.
A refund will not normally be issued solely because the customer:
changed their mind after validly losing the withdrawal right;
no longer needs the product;
lacks the knowledge or technical resources required to use it;
failed to review clearly disclosed system requirements;
expected features that were not included in the product description;
modified the product and caused the reported problem; or
experienced a conflict caused by an unsupported third-party product, service or environment.
These exclusions do not apply where they would remove a mandatory statutory right.
ScriptExpert may issue a refund on behalf of the Author and deduct the corresponding amount from the Author’s balance. A refunded licence is terminated, and the customer must stop using the product and delete all copies unless applicable law provides otherwise.
15. Customer support and complaints
Customers should first submit a support or refund request through their ScriptExpert account or by contacting support[@]scriptexpert.net.
The request should include the order details, a clear explanation of the issue and, where relevant, technical evidence such as error messages, screenshots or environment information.
ScriptExpert may share the request with the Author where necessary to investigate and resolve the issue.
We aim to handle complaints fairly, consistently and within a reasonable period. Complex technical, payment, security or intellectual-property disputes may require additional investigation.
Using a payment chargeback before allowing ScriptExpert and the Author a reasonable opportunity to investigate may delay the resolution of the case. This does not prevent a customer from exercising rights available through their payment provider or applicable law.
16. Subscription tools supplied by ScriptExpert
ScriptExpert may offer Authors subscription-based tools, plugins, extensions, analytics, promotional features, automation services or other platform functionality.
These services are provided directly by ScriptExpert rather than by third-party Authors.
Subscriptions may be offered monthly, annually or for another period shown at checkout. Unless otherwise stated, subscriptions renew automatically until cancelled.
The subscriber authorises ScriptExpert or its payment provider to charge the applicable recurring fee using the selected payment method.
A subscription may be cancelled from the account settings or by contacting support. Cancellation normally takes effect at the end of the current paid billing period, and access continues until that date.
Fees already paid for a billing period are not normally refunded solely because the subscriber stops using the service. This does not affect statutory withdrawal rights, conformity rights or refunds required because a ScriptExpert service was not supplied as described.
ScriptExpert may modify, replace or discontinue a subscription feature. Where a material change adversely affects an active paid subscription, reasonable prior notice will be provided and any mandatory cancellation or refund rights will be respected.
17. Author responsibilities
Each Author represents and warrants that they have all rights required to publish, license and commercially distribute their products.
Authors must not publish copied, stolen, “nulled”, pirated or otherwise unauthorised software. They must have permission to use all included source code, images, fonts, trademarks, libraries, data and other materials.
Product descriptions must be truthful and must not create a misleading impression about features, performance, compatibility, support, updates, ownership or affiliation.
Authors must respond reasonably to valid customer questions and conformity complaints. They must not direct customers away from ScriptExpert to avoid commissions on transactions initiated through the platform.
Authors are responsible for their products, support commitments, legal compliance, tax obligations and any loss caused by their unlawful conduct, infringement or breach of these Terms.
18. Prohibited products and conduct
ScriptExpert must not be used to distribute or promote products or activities that are unlawful, fraudulent, deceptive, harmful or infringing.
Prohibited content includes malware, ransomware, credential theft tools, unauthorised surveillance software, products designed primarily to bypass security controls, stolen source code, pirated software, deceptive financial schemes and content that unlawfully infringes intellectual-property or privacy rights.
Users must not manipulate reviews, sales, downloads, rankings or referral systems. They must not create false accounts, submit fraudulent refund requests, interfere with platform security, scrape protected data without permission or use the platform to distribute spam.
ScriptExpert may adopt additional product acceptance and prohibited-content policies. Those policies form part of these Terms where they are clearly made available to users.
19. Search ranking and product visibility
Search results, category pages and recommendations may be organised using several factors.
The principal factors may include relevance to the customer’s search, category match, completeness and accuracy of product information, product quality, customer ratings, sales history, refund and complaint history, recent updates, compatibility, Author reliability and compliance with platform rules.
The importance of each factor may vary depending on the search, category, filters and customer preferences.
Authors may be able to purchase advertising or promotional placement. Paid placements will be identified as sponsored, promoted or otherwise commercially prioritised. Payment for promotion may increase visibility but does not guarantee sales or a permanent ranking position.
ScriptExpert may also highlight new, updated, popular, well-reviewed or editorially selected products in dedicated sections.
20. Reviews and ratings
Customers may be invited to review products they have purchased or used.
Reviews must reflect a genuine experience and must not contain illegal content, personal data, threats, advertising or deliberately false information.
Authors must not purchase, fabricate, manipulate or improperly incentivise positive reviews. They must not threaten or pressure customers to remove legitimate negative feedback.
ScriptExpert may remove or restrict reviews that violate these Terms, are unrelated to the product or show credible signs of manipulation.
Where ScriptExpert states that a review is from a verified customer, this means the platform has linked the review to a transaction or another reasonable verification method.
21. Intellectual-property complaints
A rights holder or authorised representative may report a product or other content that allegedly infringes intellectual-property rights.
A report should identify the protected work, the allegedly infringing content, its location on ScriptExpert, the basis of the claim and the reporter’s contact details.
Reports may be submitted to admin[@]scriptexpert.net or through the platform’s reporting mechanism.
ScriptExpert may remove or restrict access to reported content while investigating. The affected Author may be given an opportunity to respond unless doing so would violate applicable law, a court order or a binding authority request.
Users who knowingly submit false or abusive infringement notices may be responsible for resulting loss.
22. Reporting illegal or harmful content
Users may report products, reviews, accounts or other content they reasonably believe to be illegal or contrary to these Terms.
Reports should contain enough information to identify the content and explain why action is requested.
ScriptExpert will assess sufficiently detailed reports and may remove content, restrict visibility, suspend sales, disable downloads, block payments or take other proportionate measures.
Where required, ScriptExpert will provide the affected user with information about the reason for the decision and the available appeal options.
ScriptExpert is not required to perform general monitoring of all information stored on behalf of users but may conduct voluntary investigations and use proportionate automated or manual tools to identify fraud, malware, infringement and other violations.
23. Restriction, suspension and termination
ScriptExpert may restrict a listing or account where there is a reasonable indication of:
illegal or infringing content;
fraud or payment abuse;
malware or a cybersecurity threat;
misleading product information;
repeated customer complaints;
manipulation of platform systems;
failure to provide required Author verification information; or
another serious or repeated breach of these Terms.
Where appropriate, we will prefer a proportionate action, such as restricting an individual product, before suspending an entire Author account.
Authors will normally receive a statement explaining the main reason for a restriction or suspension either before or when the decision takes effect.
Where ScriptExpert terminates the entire marketplace relationship with a professional Author, it will normally provide at least 30 days’ prior notice and a statement of reasons.
Immediate action may be taken where required by law, ordered by an authority, necessary to address fraud or a serious security risk, based on an imperative legal reason or justified by repeated violations.
Users may challenge a restriction, suspension or termination through the internal complaint process described below.
24. Internal complaints and appeals
Users may appeal a content moderation, listing restriction, account suspension or termination decision by contacting contact[@]scriptexpert.net or using the appeal option in their account.
The appeal should explain why the user believes the decision is incorrect and should include relevant supporting information.
Appeals will be reviewed in a timely, objective and non-discriminatory manner. Where appropriate, the review will be conducted by a person who was not solely responsible for the original decision.
If a decision is reversed, ScriptExpert will restore the affected content, account or access without undue delay where technically and legally possible.
Eligible users may also have access to certified out-of-court dispute settlement mechanisms under applicable law.
25. Data access
Authors may receive customer and transaction information that is reasonably necessary to supply products, provide support, meet tax obligations and handle legitimate disputes.
Authors must use this information only for those purposes and in accordance with applicable data protection law. Authors must not use customer data for unsolicited marketing unless they have an independent lawful basis and any required consent.
Authors do not receive access to confidential commercial information belonging to other Authors.
ScriptExpert may use product, account, transaction and usage information to operate the marketplace, prevent fraud, improve services, produce aggregated analytics, meet legal obligations and enforce these Terms.
Further information about personal data processing is provided in the ScriptExpert Privacy Policy.
26. Platform availability
We aim to keep ScriptExpert secure and available, but uninterrupted access cannot be guaranteed.
Maintenance, security incidents, internet failures, third-party service failures, legal requirements or circumstances outside our reasonable control may temporarily affect the platform.
We may change or discontinue non-essential platform features. Where a change materially affects a paid service, we will provide reasonable notice where possible and respect any mandatory contractual or consumer rights.
Users are responsible for maintaining appropriate backups of files, source code, documentation and other information they upload to or obtain through the platform.
27. Disclaimers relating to third-party products
ScriptExpert does not guarantee that every third-party product will be suitable for every customer, project or commercial purpose.
Product performance may depend on hosting configuration, operating systems, frameworks, libraries, third-party APIs, payment services, device models and other external factors.
Except where the law provides otherwise, ScriptExpert is not responsible for an Author’s development decisions, support failures, unlawful conduct, security vulnerabilities or inaccurate product representations.
This does not affect ScriptExpert’s obligation to provide its own services with reasonable care, process valid reports, facilitate customer complaints or comply with mandatory marketplace obligations.
28. Responsibility of ScriptExpert and Authors
ScriptExpert is responsible for operating the marketplace and for the services supplied directly by ScriptExpert.
Products offered by independent Authors are created, described, licensed and supported by those Authors. Each Author is responsible for the legality, quality, security, functionality and conformity of their products, as well as for any support or updates promised on the product page.
ScriptExpert is not responsible for losses caused exclusively by an Author, a customer, an external service or an event outside ScriptExpert’s reasonable control. This does not exclude ScriptExpert’s responsibility for its own actions, failures or legal obligations.
Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited.
29. Indemnity for business users
An Author or other business user will indemnify ScriptExpert against reasonable losses, liabilities, claims and costs arising from:
an unlawful or infringing product;
a breach of the Author’s warranties or obligations;
false or misleading product information;
malware or harmful functionality included in a product;
misuse of customer data; or
tax or regulatory obligations for which the Author is responsible.
This section applies only to users acting for business or professional purposes and only to the extent permitted by law.
30. Changes to these Terms
ScriptExpert may update these Terms to reflect legal changes, new services, security requirements or changes to the marketplace.
Consumers will be informed of material changes where required by law. Changes will not retroactively remove rights already acquired from a completed purchase.
Professional Authors will normally receive notice of proposed material changes on a durable medium at least 15 days before the changes take effect.
A longer period will be provided where an Author reasonably needs additional time to make substantial technical or commercial adaptations.
The notice period may not apply where an immediate change is required by law or is necessary to address an unforeseen and imminent risk involving fraud, malware, data breaches, spam or cybersecurity.
31. Privacy
Personal data is processed in accordance with the ScriptExpert Privacy Policy and applicable data protection law.
The Privacy Policy explains what information is collected, why it is used, how long it is retained, when it may be shared and how individuals may exercise their data protection rights.
32. Governing law and disputes
These Terms are governed by the laws of the European Union and the national laws applicable in the Member State where the ScriptExpert operator is established.
For consumers, this choice of law does not remove mandatory protections granted by the law of the country in which the consumer has their habitual residence.
Consumers may bring claims before any court that has jurisdiction under applicable consumer and private international law.
Disputes with Authors or other business users will be subject to the competent courts at ScriptExpert’s registered office, unless a different forum is required by mandatory law or agreed in writing.
Before starting court proceedings, users are encouraged to contact ScriptExpert so that the matter can be reviewed through the internal complaint process.
Where applicable, consumers may refer an unresolved complaint to a competent alternative dispute resolution body. Details of the relevant body can be provided at contact[@]scriptexpert.net.
33. Severability
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
The invalid provision will be interpreted or replaced, where legally possible, by a valid provision that most closely reflects its intended purpose.
34. No waiver
A failure or delay by ScriptExpert in enforcing a provision does not waive the right to enforce that provision later.
35. Entire agreement
These Terms, together with the Privacy Policy, Cookie Policy, applicable licence terms, Author terms, refund rules and any other policies expressly incorporated by reference, form the agreement governing use of ScriptExpert.
Where specific terms for a paid service conflict with these general Terms, the specific terms will apply to that service.
